xTool "Made to Empower" UGC Challenge - Official Rules & Agreement

Welcome to the "Made to Empower" Challenge (the "Challenge"), sponsored by xTool ("Sponsor"). By submitting your work, you acknowledge that you have read, understood, and agree to be fully bound by these Official Rules and Agreement.

Official Rules & Participation

  • Theme and Objective: The theme of this Challenge is "Made to Empower."  Participants are encouraged to share how xTool has empowered their creativity by showcasing a positive transformation or a significant creation made possible by using xTool products.
  • Challenge Period:
    - Submission Period: The Challenge begins on September 1 and ends on September 26.
    - Winner Announcement: Winners will be announced through xTool's official channels on September 29.
  •  How to Enter:
    - Create Content: Produce an original video or image that aligns with the "Made to Empower" theme, showcasing a "before and after" transformation or telling a personal story related to your creation.
     - Publish: Post your original content publicly on Instagram / TikTok / YouTube / Facebook / Reddit.
    - Tag Correctly: Your post must include the official hashtag #xToolEmpower and mention @xToolOfficial.
    - Submit to Qualify: To ensure your entry is valid, you must submit a link to your post and your contact information via the submission link provided in the bio of our official social media accounts.
  • Prizes:
    - Grand Prize (1 winner): A $1,000 USD xTool Gift Card.
    - Special Awards (5 winners): A $300 USD xTool Gift Card for each winner.
    - Participation Prize (all eligible participants): A $30 USD xTool Gift Card for each participant. - Note: All gift cards can be combined with other coupons on the official xTool website.
  • Eligibility: The Challenge is open to individuals who are 18 years of age or the age of legal majority in their jurisdiction of residence. No purchase is necessary to enter or win. A purchase will not increase your chances of winning. Void where prohibited by law.

Judging Criteria & Process

All eligible entries will be evaluated by an internal panel of judges from xTool based on the following criteria. The weighting of each criterion will be determined at the sole discretion of the judging panel.

  • Relevance to Theme: The extent to which the submission aligns with, interprets, and conveys the core theme of "Made to Empower."
  • Creativity & Originality: The novelty of the idea, uniqueness of the concept, and artistic expression of the submission.
  • Storytelling & Emotional Impact: The appeal and coherence of the story being told and its ability to evoke an emotional response from the audience.
  • Quality of Submission: The visual clarity, technical skill (e.g., filming, editing, composition), and overall production value of the submitted content.
  • Community Engagement: The judging panel will assess the organic and authentic interaction a submission inspires within the community. This criterion considers the quality of engagement over sheer quantity. Submissions that effectively encourage others to voluntarily share (e.g., sharing to a personal Story), spark genuine discussion in the comments, or tag (@) friends to view the content may be viewed as having higher community engagement.

Note: A participant may be disqualified under any of the following circumstances:
- The submission is determined by the review panel to constitute plagiarism.
- It is found during the evaluation process that the participant is ineligible to participate.- The participant provides false information or violates applicable laws or regulations.
- The submission or the participant’s conduct infringes upon any legitimate rights of a third party, including but not limited to intellectual property rights, rights of publicity or privacy, confidentiality obligations, reputation rights, or moral rights. Submitting any false, defamatory, infringing, harmful, pornographic, offensive, bullying, harassing, defamatory, hateful, inciting, threatening, profane, obscene, invasive of privacy, or otherwise objectionable entry, or engaging in any conduct in connection with the contest that includes, without limitation, promoting illegal activities, explicit sexual content, promotion of violence, or any discriminatory or unlawful content or behavior, or any conduct that under applicable law causes or may cause damage to personal property or injury, or may give rise to civil, criminal, or other liability.

Terms of Use

  • License Grant: While you retain ownership of your submission, by entering the Challenge, you grant the Sponsor and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable, and sublicensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and display your submission (in whole or in part) and your name, likeness, social media username, and biographical information, in any and all media now known or hereafter devised, for any purpose, including but not limited to advertising, marketing, and promotional activities, without any further notice, compensation, or approval from you.
  • Your Representations and Warranties: You represent and warrant that:
     - Your submission is your own original work.
     - You own or control all rights to your submission sufficient to grant the license set forth herein.
     - Your submission does not infringe upon the rights of any third party, including but not limited to copyright, trademark, patent, trade secret, privacy, publicity, or any other intellectual property or proprietary rights.
     - Your submission does not contain any libelous, defamatory, obscene, unlawful, or offensive content.
     - You have obtained all necessary licenses and consents from any identifiable individuals featured in your submission.
  • Indemnification: You agree to indemnify, defend, and hold harmless the Sponsor, its officers, directors, employees, and agents from and against any and all claims, liabilities, losses, damages, and expenses (including reasonable attorneys' fees) arising out of or in connection with any breach by you of any representation, warranty, or obligation in this Agreement.
  • Limitation of Liability: To the fullest extent permitted by law, the Sponsor shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of your participation in the Challenge or the acceptance, use, or misuse of any prize.

Privacy Policy

We are committed to protecting your privacy. This policy outlines how we collect, use, and safeguard your personal information for this Challenge.

  • Information We Collect: We collect information you voluntarily provide when you enter the Challenge, which may include:
     - Your name and contact information (e.g., email address).
     - Your social media username.
     - The link to your submission.
  • Use of Information: We use your information to:
     - Administer and manage the Challenge, including verifying entries and selecting winners.
     - Communicate with you regarding the Challenge, including winner notifications.
     - Fulfill and deliver prizes.
     - For marketing and promotional purposes as described in the "Terms of Use" section of this Agreement.
  • Information Sharing and Disclosure: We do not sell your personal information to third parties. We may share your information only in the following circumstances:
    - With third-party service providers who assist us with services such as prize distribution.
    - As required by law or to respond to valid legal processes.
    - To protect the rights, property, or safety of the Sponsor.
  • Your Rights: You have the right to access, correct, or request the deletion of your personal information held by us. To exercise these rights, please contact us using the information provided below.

General Conditions

  • Challenge Modification and Termination: The Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the Challenge if fraud, technical failures, or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Challenge.
  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the United States, without regard to any conflict of law principles. Any disputes arising out of this Challenge shall be subject to the exclusive jurisdiction of the federal and state courts located in California, USA.
  • Sponsor Information: This Challenge is sponsored by xTool. This Challenge is in no way sponsored, endorsed, or administered by, or associated with, any social media platform, including but not limited to Instagram, TikTok, or YouTube.
